Terms of Service

These terms govern your use of the Lushera website and, once available, the Lushera salon-management software, both provided by Azury Digital. By using Lushera you agree to these terms.

1. Who we are

Lushera is a product of Azury Digital & Tech Solutions Ltd ("Azury Digital", "we", "us"), a company registered in England and Wales (company number 13446812), registered office 23a The Precinct, London Road, Waterlooville PO7 7DT. You can reach us at info@azurydigital.co.uk.

2. The service

Lushera is a cloud-based (SaaS) salon-management application, offered in two editions from one codebase:

• Lushera — the full salon suite, for owners running a team: multi-stylist diary, shared client database, staff and wages, stock, money and tax-year reporting, reminders, marketing and an online booking page.
• Lushera Solo — the chair-renter edition, for freelance stylists: a single diary and client book, colour and patch-test records, income and expenses with chair rent tracked automatically, and a personal booking page.

You choose your working style at first login and Lushera enables the appropriate modules. It runs in your web browser. We work to keep the service available and secure, but we do not guarantee uninterrupted service and may occasionally carry out maintenance or update features.

3. Your account

You need an account to use Lushera. You are responsible for keeping your login details secure and for activity under your account, and we recommend enabling two-factor authentication. Paid features are available on confirmation of a valid subscription.

4. Acceptable use

You agree not to misuse the service, attempt to break or probe its security, disrupt it for others, or use it for anything unlawful. You must not use Lushera to send messages to people who have not agreed to receive them — the marketing tools are consent-first by design, and you remain responsible for complying with UK marketing rules (PECR and the UK GDPR).

5. Your data and your clients' data

You own the data you enter. You are responsible for its accuracy and for having a lawful basis to hold information about your own clients and staff, for whom you act as data controller; Azury Digital acts as your data processor and handles that data only to provide the service (see our Privacy Policy). A Data Processing Agreement is available. You are responsible for obtaining any consent required from your clients, including for patch-test (health-related) records and for marketing.

6. Subscriptions and pricing

Lushera is offered on a monthly subscription, with a lighter plan for Lushera Solo. Plans and prices are still to be confirmed and will be published before the service goes on sale. Prices will be in GBP. We may change our prices from time to time and will give reasonable notice of any change to a paid plan you are on.

7. Payment

When paid plans and card features go live, payments will be handled securely by Stripe. Subscriptions will continue until cancelled and renew automatically at the interval shown at purchase; you will be able to cancel at any time to stop future renewals and keep access until the end of the period you have paid for. We do not see or store your full card details.

8. Not a substitute for professional advice

Lushera's money and tax-year features help you keep records and produce summaries for your accountant. They are reporting tools, not payroll and not an accountant or tax adviser, and Lushera does not file anything with HMRC (no RTI or MTD submission). You remain responsible for your own tax affairs and for what you file, and we recommend your figures are reviewed by your accountant.

9. Intellectual property

We (or our licensors) own all intellectual property in Lushera and its content. Your subscription grants you a limited, non-exclusive, non-transferable licence to use Lushera for your business — it does not transfer ownership.

10. Disclaimers and limitation of liability

We provide Lushera with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of data caused by factors outside our reasonable control. Nothing in these terms limits liability that cannot legally be excluded (such as for death or personal injury caused by negligence, or for fraud). We strongly recommend you keep your own copies of important records.

11. Termination

You can stop using Lushera and cancel any paid plan at any time. We may suspend or end access if these terms are seriously or repeatedly breached. On termination we will handle your data in line with our Privacy Policy and the Data Processing Agreement.

12. Changes to these terms

We may update these terms from time to time. The "last updated" date at the top shows when they last changed; where a change materially affects a paid plan you are on, we will give reasonable notice.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
